Terms of Service

1. Agreement
These Terms govern access to Noggin, a recruiting software service operated by Staffify. By creating an account or using Noggin, you agree to these Terms on behalf of yourself and, where applicable, your organization.
2. Accounts and Authorized Use
You must provide accurate account information, protect login credentials, and use Noggin only for lawful business purposes. You are responsible for activity by users you authorize and for obtaining any notices, permissions, or legal bases required for information you process through the service.
3. Recruiting and AI Outputs
Noggin supports recruiting work but does not make employment decisions. AI-generated searches, drafts, scores, summaries, and recommendations may be incomplete or incorrect and must be reviewed by qualified people. You may not use Noggin to make unlawfully discriminatory decisions or as the sole basis for a consequential employment decision.
4. Customer Data
You retain ownership of information you submit to Noggin. You grant Staffify the limited rights necessary to host, process, transmit, and display that information to provide and improve the service. You represent that you have the authority to provide the information and direct its processing.
5. Acceptable Use
You may not misuse the service, interfere with its operation, bypass access controls, introduce malicious code, scrape or resell the service, infringe others’ rights, send unlawful communications, or use Noggin in violation of employment, privacy, anti-spam, or other applicable laws.
6. Fees, Trials, and Changes
Paid plans, included usage, billing intervals, and trial terms are described at purchase. Fees are non-refundable except where required by law or stated in an order. We may change features or pricing prospectively and will provide reasonable notice when a change materially affects an active paid plan.
7. Availability and Third-Party Services
We work to keep Noggin reliable but do not promise uninterrupted service. Integrations and third-party services are governed by their own terms, and Staffify is not responsible for changes or outages outside its control.
8. Suspension and Termination
You may stop using Noggin at any time. We may suspend or terminate access for material breach, security risk, unlawful use, or nonpayment. Sections that by their nature should survive termination will remain in effect.
9. Disclaimers and Liability
To the extent permitted by law, Noggin is provided “as is” and without implied warranties. Staffify will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities. Additional limits may be stated in an applicable order form.
10. Governing Terms and Contact
These Terms, together with any order form and incorporated policies, are the complete agreement regarding Noggin. Formal company address, governing law, and dispute terms should be confirmed in your executed order form. Questions may be submitted through Staffify’s support channels.
